Terms of Service

Please read these terms carefully before using our platform.

Welcome to PayPig Australia. These Terms of Service ("Terms") govern your access to and use of the PayPig Australia website and platform located at paypigaustralia.com.au ("Platform"), operated by PayPig Australia Pty Ltd ("we", "us", or "our"). By creating an account or using the Platform you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years of age to register for or use the Platform. By creating an account you represent and warrant that:

  • You are at least 18 years old;
  • You are a resident of Australia or otherwise permitted under applicable law to access adult-oriented platforms;
  • You have the legal capacity to enter into a binding agreement;
  • You are not on any government list of prohibited or restricted parties.

We reserve the right to verify your age and identity at any time and to suspend or terminate your account if we reasonably believe you do not meet these requirements.

2. Account Registration

You must provide accurate, complete, and current information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@paypigaustralia.com.au if you suspect any unauthorised use of your account.

You may not create more than one account, use another person's account, or create an account on behalf of another person without their express consent.

3. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

  • Post content that is unlawful, defamatory, harassing, threatening, or obscene under Australian law;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity;
  • Solicit money or gifts through deception, coercion, or fraudulent misrepresentation;
  • Engage in any interaction that is not fully consensual;
  • Attempt to circumvent, disable, or interfere with security features of the Platform;
  • Use automated scripts, bots, or scrapers to access the Platform;
  • Distribute spam, chain letters, or unsolicited commercial communications;
  • Upload or transmit viruses or other malicious code;
  • Collect or harvest any personally identifiable information from other users without their explicit consent.

4. Consent and Community Standards

All financial exchanges and power dynamics facilitated through the Platform must be entirely consensual between adults. PayPig Australia operates on the principle that all interactions are consensual lifestyle choices made by informed adults.

We maintain a zero-tolerance policy for harassment, coercion, non-consensual contact, and any form of exploitation. Violations will result in immediate account termination and may be reported to relevant authorities.

5. User Content

You retain ownership of any content you post on the Platform ("User Content"). By posting User Content, you grant us a non-exclusive, royalty-free, worldwide licence to use, store, display, and distribute that content solely for the purpose of operating and improving the Platform.

You represent and warrant that your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.

We reserve the right to remove any User Content that violates these Terms or our Community Guidelines at our sole discretion, without notice.

6. Premium Memberships and Payments

We offer optional paid premium membership tiers ("Premium Membership"). By purchasing a Premium Membership you agree to the applicable fees displayed at the time of purchase.

  • All prices are in Australian Dollars (AUD) and include GST where applicable;
  • Subscriptions are billed in advance on a recurring basis unless cancelled;
  • You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period;
  • Refunds are provided at our discretion in accordance with applicable Australian Consumer Law.

7. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

8. Intellectual Property

The Platform and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of PayPig Australia Pty Ltd. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. Third-Party Links

The Platform may contain links to third-party websites or services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit.

10. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by Australian law, PayPig Australia Pty Ltd and its directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.

12. Indemnification

You agree to indemnify, defend, and hold harmless PayPig Australia Pty Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgements, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising from your violation of these Terms or your use of the Platform.

13. Termination

We may terminate or suspend your account at any time, with or without cause, with or without notice, including if we believe you have violated these Terms. Upon termination your right to use the Platform will immediately cease.

You may delete your account at any time through your account settings or by contacting us at support@paypigaustralia.com.au.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. You submit to the exclusive jurisdiction of the courts of New South Wales.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days notice of material changes by email or by prominent notice on the Platform. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
